Western Heritage Case: Explanation

To explain further: Now there are four actions going on in one combined case, and the global time for discovery issues, pre-trial motions, etc. to be resolved and the whole case ready to submit for trial is February of 2016. The Note of Issue filing date is the date at which any and all such pre-trial matters MUST BE COMPLETELY RESOLVED so that the Court can schedule a trial on the outstanding issues of fact.

If a settlement is going to happen, it will have to happen well before February 2016. Frankly, the case may very well get resolved by a summary judgment motion and never make it to trial.
