What is a Summary Judgment ?
December 19, 2014
A Summary Judgment is a procedure used in a Court of Law. Either a Plaintiff or a Defendant may apply for summary judgment; it is not uncommon for both parties to seek it. A judge may also determine on his own initiative that summary judgment is appropriate.
The side that is asking for summary judgment will have to convince the judge that the evidence that would be presented in the trial so obviously favors them that there in no need to actually have a trial, because there is no dispute as to who should win the case.
The judge can decide to end the case right there without waisting time by going to trial when the outcome is so obvious already.
The point of summary judgment is to save everyone's time and come to a conclusion in a case where the evidence so strongly favors one side that there is really nothing to dispute if the case where to go to trial.
